Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and related services (collectively, the "Services") provided by hexaTune LLC ("hexaTune," "we," "us," or "our"). Our Services include applications available on the Apple App Store and Google Play Store, including but not limited to hexaGenApp.

By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use our Services. If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use our Services with the consent of a parent or legal guardian who agrees to be bound by these Terms.

2. License Grant

Subject to your compliance with these Terms, hexaTune grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our applications on devices that you own or control, solely for your personal, non-commercial use.

This license does not grant you any rights to use hexaTune's trade names, trademarks, service marks, or logos.

3. Open-Source Components

Certain components of our Services are released as open-source software under the MIT License through our open-source organization, hTuneSys. These open-source components are governed by their respective license terms. Nothing in these Terms restricts or limits your rights under the applicable open-source licenses.

The MIT License for open-source components is available in the respective project repositories at github.com/hTuneSys.

4. In-App Purchases and Subscriptions

4.1 Availability

Our applications may offer in-app purchases, including but not limited to premium features, subscriptions, and digital content (collectively, "Paid Content"). Paid Content availability and pricing may vary by region.

4.2 Payment Processing

All purchases within our applications are processed through the respective platform's payment system:

• iOS: Apple App Store, managed by Apple Inc.
• Android: Google Play Store, managed by Google LLC.

By making a purchase, you agree to the payment terms of the respective platform. All prices are displayed in your local currency as determined by the platform.

4.3 Subscriptions

If you purchase a subscription:

• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
• You can manage and cancel subscriptions through your device's App Store or Google Play settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to Paid Content until the end of that period.
• We may change subscription pricing with advance notice. Continuing your subscription after a price change constitutes acceptance of the new price.

4.4 Refunds

Refund requests for in-app purchases are subject to the refund policies of the respective platform:

• Apple: Request a refund from Apple
• Google: Request a refund from Google Play

hexaTune does not directly process refunds for purchases made through the App Store or Google Play. Please contact the respective platform for refund requests.

4.5 Free Trials

We may offer free trial periods for certain subscriptions. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the then-current subscription price.

5. User Conduct

You agree not to:

• Use our Services for any unlawful purpose or in violation of any applicable laws or regulations
• Reverse engineer, decompile, or disassemble any proprietary portions of our Services (open-source components are governed by their respective licenses)
• Attempt to gain unauthorized access to our Services, servers, or networks
• Interfere with or disrupt the integrity or performance of our Services
• Use automated means (bots, scrapers, etc.) to access our Services without our prior written consent
• Remove, alter, or obscure any proprietary notices or labels on our Services
• Use our Services to transmit viruses, malware, or other malicious code
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

6. Intellectual Property

Except for open-source components released under the MIT License, all content, features, functionality, trademarks, and other intellectual property associated with our Services are owned by hexaTune LLC and are protected by international copyright, trademark, patent, and other intellectual property laws.

The hexaTune name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of hexaTune LLC. You may not use these marks without our prior written consent.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Our Services will be uninterrupted, secure, or error-free
• The results obtained from our Services will be accurate or reliable
• Any defects in our Services will be corrected
• Our Services will be compatible with all devices or operating systems

hexaTune technologies involve signal generation and frequency experimentation. Our Services are provided for informational and experimental purposes only and are not intended to diagnose, treat, cure, or prevent any medical condition. You use our Services at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEXATUNE LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) our Services
• Any conduct or content of any third party on our Services
• Any content obtained from our Services
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO OUR SERVICES EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS (USD $50), WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless hexaTune LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your license to use our Services will immediately cease
• You must uninstall and destroy all copies of our applications
• Provisions that by their nature should survive termination shall survive (including Sections 6, 7, 8, 9, and 12)

Termination does not entitle you to a refund of any Paid Content, except as required by applicable law or the policies of the respective platform (Apple/Google).

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using our Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and hexaTune LLC regarding your use of our Services and supersede all prior agreements and understandings.
